Custody

Types of Custody

  • Legal Custody: Determines who will make important decisions for the child, including those related to education, healthcare, and religious upbringing.

  • Physical Custody: Specifies where the child will live, which influences their school and community connections.

How Custody is Determined

The court considers several factors to determine custody, including:

  • The age and health of the child

  • Emotional ties between the child and each parent

  • The child’s connection to their school, home, and community

  • The best interests of the child

Divorce

How Long Will a Divorce Take?

There is a mandatory six-month waiting period from the time your spouse is served with the divorce petition until a divorce decree can be granted.

Types of Divorce

  • Contested Divorce: The spouses disagree on one or more issues in the divorce, such as property division or support. In these cases, the court will make decisions to resolve the disputes.

  • Uncontested Divorce: The spouses agree on all terms of the divorce, allowing them to resolve matters without court intervention.

Fact: You may not need to go to court if all parties agree on the terms of the divorce, including custody, support, and property division.
